Welcome to Uptown ATX Studio! These Terms of Service (“Terms”) govern your access to and use of our website, uptownatxstudio.com (the “Site”), and any photography services, digital products, or related offerings (collectively, the “Services”) provided by Uptown ATX Studio LLC (“Studio,” “we,” “us,” or “our”).

By accessing our Site or booking our Services, you agree to be legally bound by these Terms. If you do not agree, please do not use our Site or book our Services.

1. Eligibility

You must be at least 18 years old to book services or make payments through our Site. By using our Services, you represent that you meet this requirement.

2. Booking and Payment

• Deposits: A non-refundable deposit (amount specified at booking) is required to secure your session date.
• Final Payment: Remaining balances must be paid in full before final images are released.
• Accepted Methods: We accept credit/debit cards, ACH, and other methods listed at checkout.
• Late Payments: Invoices not paid by the due date may incur late fees and may delay image delivery.

3. Cancellations and Rescheduling

• Client Cancellation: Cancellations made at least 72 hours before the session date may be rescheduled without penalty. Deposits remain non-refundable.
• Rescheduling: Sessions can be rescheduled once, provided notice is given at least 72 hours in advance.
• Studio Cancellation: If we must cancel due to illness, weather, or unforeseen events, you may reschedule or request a full refund of your deposit.

4. Image Rights and Usage

• Ownership: All images remain the intellectual property of Uptown ATX Studio LLC.
• Client License: Clients receive a non-exclusive, non-transferable license for personal or agreed-upon commercial use.
• Studio Portfolio Use: Unless otherwise agreed in writing, the Studio reserves the right to use images for marketing, portfolio, and promotional purposes.

5. Model Release

By participating in a photography session, you grant Uptown ATX Studio permission to use your likeness and images in marketing materials, portfolio galleries, and social media unless you notify us in writing prior to your session that you do not consent.

6. Deliverables and Turnaround

• Standard turnaround times are provided at the time of booking.
• Rush delivery may be available for an additional fee.
• Final images will be delivered digitally unless otherwise agreed in writing.

7. Limitation of Liability

While we take every precaution to ensure quality service and safe handling of your images, Uptown ATX Studio will not be liable for:

• Acts of God, equipment failure, or circumstances beyond our control.
• Indirect, incidental, or consequential damages arising from use of our Services or Site.

Our total liability for any claim shall not exceed the amount you paid for the applicable Service.

8. Refund Policy

Deposits are non-refundable. Full refunds of any additional payments (excluding deposits) may be issued only if the Studio cancels and you do not reschedule.

9. Site Use

You agree to use the Site only for lawful purposes. You may not attempt to:

• Interfere with or disrupt Site functionality;
• Use any automated means to access or scrape our content;
• Infringe on our intellectual property or that of others.

10. Third-Party Links

Our Site may include links to external websites. Uptown ATX Studio is not responsible for the content, privacy policies, or practices of any third-party websites.

11. Updates to These Terms

We may revise these Terms at any time. Updates will be posted on this page with a new “Last Updated” date. Your continued use of our Site or Services after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any disputes shall first attempt resolution through informal negotiation. If unresolved, disputes will be handled exclusively in the courts of Travis County, Texas.
